Il \u00e9tait poursuivi par son petit fr\u00e8re, Karim (nom d\u2019emprunt), pour des faits de stellionat survenus dans la commune rurale de Kouka, province des Banwa, il y a une vingtaine d\u2019ann\u00e9es.<\/p>\n<p>Selon la plainte, Moussa, \u00e2g\u00e9 de 62 ans, aurait vendu un terrain familial d\u2019un hectare sans informer son petit fr\u00e8re, pourtant propri\u00e9taire l\u00e9gitime du bien h\u00e9rit\u00e9 de leur d\u00e9funt p\u00e8re il y a 25 ans.<\/p>\n<p>\u00c0 la barre, le pr\u00e9venu a justifi\u00e9 son acte en d\u00e9clarant que tous ses fr\u00e8res \u00e9taient partis en aventure et que d\u2019autres personnes tentaient de s\u2019accaparer du terrain.<\/p>\n<p>D\u2019apr\u00e8s le procureur du Faso, l\u2019enqu\u00eate pr\u00e9liminaire a r\u00e9v\u00e9l\u00e9 que le p\u00e8re des deux fr\u00e8res avait l\u00e9gu\u00e9 trois hectares \u00e0 ses enfants. Moussa aurait b\u00e9n\u00e9fici\u00e9 de deux hectares qu\u2019il avait d\u00e9j\u00e0 vendus. Par la suite, il aurait \u00e9galement c\u00e9d\u00e9 le troisi\u00e8me hectare, appartenant \u00e0 Karim, \u00e0 550 000 F CFA, alors que ce dernier se trouvait au Mali pour des raisons professionnelles.<\/p>\n<p>\u00c0 son retour au pays, Karim a voulu revendre sa parcelle \u00e0 un tiers. Mais il a d\u00e9couvert que le terrain en question avait d\u00e9j\u00e0 \u00e9t\u00e9 vendu par son grand fr\u00e8re. Il affirme avoir \u00e9t\u00e9 inform\u00e9 de cette vente il y a environ sept ans, mais n\u2019a d\u00e9cid\u00e9 de porter plainte qu\u2019en septembre 2025.<\/p>\n<p>Lors de l\u2019audience, il a toutefois tent\u00e9 de corriger ses d\u00e9clarations en affirmant qu\u2019il n\u2019avait appris la vente que trois ans plus t\u00f4t, sans parvenir \u00e0 convaincre le tribunal. Karim s\u2019est constitu\u00e9 partie civile et a r\u00e9clam\u00e9 la somme de 60 millions F CFA \u00e0 son grand fr\u00e8re \u00e0 titre de d\u00e9dommagement.<\/p>\n<p>Le procureur du Faso a rappel\u00e9 que le stellionat est un d\u00e9lit dont le d\u00e9lai de prescription est de cinq ans. En cons\u00e9quence, il a requis que l\u2019action publique soit d\u00e9clar\u00e9e \u00e9teinte pour cause de prescription.<\/p>\n<p>Le tribunal a suivi cette r\u00e9quisition.<br \/>\nIl a donc
